Regular City Commission Meeting Mayor Pro Tempore Bill Beecher presiding

CALL TO ORDER: 7:00 PM

ROLL CALL: City Commissioners present: Bill Beecher, Sandy Hinz, Diane Jovick-Kuntz and John Rosenbaum. Randy Gray was excused. Also present were the City Manager, Assistant City Manager, City Attorney, Directors of Community Development, Library, Fire Chief, Park and Recreation, Public Works, Planning, Budget/MIS, Fiscal Services, State Fair, Acting Police Chief, and the Deputy City Clerk.

PUBLIC HEARINGS

Sale of City-Owned Park Land: L24, B6, Henderson Heights Addn. Approved.

1.
SALE OF CITY-OWNED PARK LAND: L24, B6, HENDERSON HEIGHTS ADDITION, A SUBDIVISION IN THE NE 1/4 SECTION 35 T21N, R3E, P.M. MT, CASCADE COUNTY, MONTANA.

The Great Falls Comprehensive Park and Recreation Master plan identified ten parcels of undeveloped park land, including the Henderson Park property, as surplus and recommended that these parcels be sold. The Plan further recommended that if there was interest by the neighbors in developing the park, the City would not sell the property for a period of one year to allow residents the opportunity to develop a financial plan for the improvements. No interest in developing this Park has been expressed by the neighborhood. Bids were opened on November 22, 2000, with only one bid received from Betty Hauer in the amount of $41,851. The minimum acceptable bid for Lot 24 was $41,850.

Mayor Pro Tempore Beecher declared the public hearing open. No one spoke in support of or opposition to the sale of park land.

Commissioner Jovick-Kuntz moved, seconded by Commissioner Hinz that the City Commission approve the sale of the land.

Motion carried 4-0.

Ord. 2791, Amending Title 15, Chapter 15.09, OCCGF. Adopted.

ORDINANCE 2791, AMENDING UNIFORM BUILDING AND CONSTRUCTION CODES PERTAINING TO TITLE 15, CHAPTER 15.09, OCCGF, PLUMBING CODE.

Administrative rules of the State of Montana require that local governments with a code enforcement program must, within 90 days of receipt of notice, update the local codes to the latest codes adopted by the State. The State of Montana adopted these codes and amendments on November 13, 2000. Adoption of Ord. 2791 would adopt the 2000 Edition of the Uniform Plumbing Code with amendments, replacing the 1997 Edition.

Mayor Pro Tempore Beecher declared the public hearing open. No one spoke in support of or opposition to Ord. 2791. Mayor Pro Tempore Beecher closed the public hearing.

Commissioner Rosenbaum moved, seconded by Commissioner Jovick-Kuntz that the City Commission adopt Ordinance 2791.

Motion carried 4-0.

NEW BUSINESS

Comprehensive Annual Financial Report, FY 1999-2000. Accepted.

COMPREHENSIVE ANNUAL FINANCIAL REPORT (CAFR), FISCAL YEAR 1999-2000.

Junkermier, Clark, Campanella, Stevens, P.C., Certified Public Accountants, conducted the City's FY 1999-2000 Annual Audit. Auditor Dan Konen briefly explained the CAFR.

Commissioner Hinz moved, seconded by Commissioner Rosenbaum that the City Commission accept the Comprehensive Annual Financial Report for Fiscal Year 1999-2000.

Motion carried 4-0.

ORDINANCES/RESOLUTIONS

Ord. 2793, Title 2, OCCGF, Attendance Requirements on Boards, Commissions, and Councils. Accepted on first reading.

ORDINANCE 2793, SUPPLEMENTING TITLE 2, OCCGF, PERTAINING TO ATTENDANCE REQUIREMENTS ON BOARDS, COMMISSIONS, AND COUNCILS.

As a result of the chronic absence of some members appointed to Boards, Commissions, and Councils in the past, it is necessary to establish a policy whereby any such member who misses more than one-third of regular meetings in a calendar year without a health or medical excuse shall be removed and replaced.

Commissioner Jovick-Kuntz moved, seconded by Commissioner Rosenbaum that the City Commission accept Ordinance 2793 on first reading.

Motion carried 4-0.

Ord. 2794, Amending OCCGF 15.12, Adopt 1997 Uniform Fire Code. Accepted on first reading and set public hearing for January 2, 2001.

ORDINANCE 2794, AMENDING OCCGF 15.12, ADOPTING THE 1997 UNIFORM FIRE CODE.

State law requires municipalities adopt local fire codes that meet the minimum standard that the State has adopted. The City may adopt stricter requirements, but they may not be more lenient. The State has adopted the 1997 Uniform Fire Code.

Commissioner Hinz moved, seconded by Commissioner Rosenbaum that the City Commission accept Ordinance 2794 on first reading and set the public hearing for January 2, 2001.

Motion carried 4-0.

Res. 9125, Interfund Loan to Golf Course Fund. Adopted.

6.
RESOLUTION 9125, INTERFUND LOAN TO GOLF COURSE FUND.

Provides necessary loan funding for completion of the irrigation system and renovation of four holes at Eagle Falls Golf Club. The interfund loan in an amount not to exceed $400,000 from the Park Land Trust in the Park and Recreation Special Revenue Fund No. 261 to the Golf Courses Fund No. 561 would be paid back at 6% interest over seven years.

Commissioner Rosenbaum moved, seconded by Commissioner Jovick-Kuntz, that the City Commission adopt Resolution 9125.

Commissioner Jovick-Kuntz asked when the completion of the Eagle Falls Golf Club renovation would be done. Jerry Sepich responded that construction should be completed by June 15, 2001, plus grow-in time.

Motion carried 4-0.

Bid Award, One-Ton Cab and Chassis. Awarded bid for one new 2001 Dodge cab and chassis to Ronan Auto Body Sales in the amount of $17,920, including $4,100 trade-in offer.

Contract Bid Award, Eagle Falls Golf Club Renovation Phase II (OF 906.3). Awarded contract in the amount of $405,180 to Huppert Brothers Construction for the Eagle Falls Golf Club Renovation Phase II.
15.
Final Payment, Phase 1 Historic Preservation of the 10th Street Bridge (OF 979.1). Authorized final payment to Tamietti Construction Company and the State Miscellaneous Tax Division in the amount of $58,374 for Phase 1 improvements to the 10th Street Bridge.
16.
Engineering Services Contract, Wastewater Plant Area Petroleum Contamination Study (OF 1176.2). Approved the Engineering Services Contract with Neil Consultants, Inc., for the estimated maximum fee of $10,000.

Software Contract License Agreement, New World Systems. Approved agreement with New World Systems for additional components to current public safety software.

Commissioner Rosenbaum moved, seconded by Commissioner Jovick-Kuntz, that the Consent Agenda be approved as printed.

BOARDS & COMMISSIONS

Cascade County Conservation District. Reappointment Gestring.

18.
REAPPOINTMENT, CASCADE COUNTY CONSERVATION DISTRICT.

The term of Cascade County Conservation District member Charles Gestring expires on December 31, 2000. Mr. Gestring has served on the Board since 1989. He has been an active member of the Board and is interested in reappointment. The Conservation District is recommending his reappointment.

Commissioner Hinz moved, seconded by Commissioner Jovick-Kuntz that the City Commission reappoint Charles Gestring to the Cascade County Conservation District Board to a three-year term expiring December 31, 2003.

Motion carried 4-0.

Neighborhood Council 2, Neighborhood Watch Signs. Submitted invoice.

19.
NEIGHBORHOOD COUNCIL NO. 2, NEIGHBORHOOD WATCH SIGNS.

Neighborhood Council 2 representative Sue Strickland presented the City Commission with an invoice for $60 to pay for Neighborhood Watch signs that were posted in the neighborhood.

Dog Violations. Citizen Comment.

PETITIONS AND COMMUNICATIONS.

Greg Keske wanted to express his appreciation to the Great Falls Police Department for their quick response to a recent incident he had reported. He also expressed his opinion that the leash laws need to be better enforced.
