JOURNAL OF COMMISSION WORK SESSIONS
APRIL 7, 1998

City Commission Work Session Mayor Joan Bennett presiding

CALL TO ORDER: 5:45 P.M.

PRESENT: Mayor Bennett, Commissioners Beecher, Gray, and Rosenbaum. Commissioner Downer was excused. Also present were City Manager, City Attorney, Directors of Community Development, Park & Recreation, Management Information Services, Planning, Library, Public Works, Fire Chief, and City Clerk.

WORK SESSION BUSINESS

1.
VARIANCE REQUEST, GF 12TH ADD B161, L14.

Jim and Susan Balek, owners of the property located at 3001 5th Avenue North, requested a variance to OCCGF 17.47.010. The variance requested would reduce the required front setback from 30' to 18'. The applicants want to build a 12' x 24' garage addition.

The Board of Adjustment met to discuss the variance requested. The Board considered the orientation of the home on the corner lot and the inability to build in another direction. The Board consensus was that the variance criteria were met. The Board voted unanimously to recommend that the City Commission approve the variance request. It was the consensus of the City Commission to concur with the Board's recommendation to approve the variance.

VARIANCE REQUEST, SUNRISE HOMES ADD B5 L1-7, 7A.

Drew Hogan, serving as agent for Russ McDaniel, requested a variance to OCCGF 15.11.200. The variance asks approval to install two hundred and sixty-six square feet of wall signage. The maximum allowed wall signage is two hundred square feet. In return for the additional wall signage, the property owner agreed to relinquish any claim to the one hundred square feet of roof signage permitted by the Code.

City Code requires that an area limitation for wall signage is set at two hundred square feet per premise. The Ace Hardware store wanted to install a 146 square feet of new signage along the front of the building and 120 square feet on the rear of the building.

The Board of Adjustment heard the request and comments during the discussion centered on the fact that the trade off conditions are in the City's favor. The Board voted unanimously to recommend that the City Commission accept the signage trade off proposal and approve the variance request.

It was the consensus of the City Commission to concur with the Board of Adjustment's recommendation to approve the variance request.

3.
VARIANCE REQUEST, GF TOWNSITE B348.

Mr. Jack Manning, owner of the property located at 211 3rd Avenue North, requested a variance to OCCGF 17.90.V.B.2. The variance would reduce the required east side yard setback from 6' to 3'11". The applicant wants to build an addition to the existing home.

The Board of Adjustment heard the request at a meeting on March 26, 1998. The Board questioned Staff on the meaning of the Revitalization Area designation and discussed the properties enjoying a non-conforming use and made a special note of the neighborhood support of the variance request. The Board voted unanimously to recommend that the City Commission approve the request.

The City Commission concurred with the Board of Adjustment's recommendation for approval.

4.
NEIGHBORHOOD COUNCIL UPDATE.

Kim Thiel, Neighborhood Council liaison, updated the City Commission on the issues the Neighborhood Councils were talking about at their meetings.
